Conservatorships are a formal probate process on behalf of a person who is not able to provide for his/her personal needs or is not able to manage his/her finances. In many cases, Conservatorships are used to prevent an elderly person suffering from Alzheimer, dementia or other disease from depleting his/her personal savings and assets.
Types of Conservatorships
There are two forms of Conservatorships:
- Conservatorships of the Person
- Conservatorships of the Estate
Conservatorships of the Person may be appointed for a person who is unable to provide for his/her personal needs, such as food, clothing, shelter and health.
Conservatorships of the Estate may be appointed for a person who is unable to manage his/her personal finances, resist fraud or undue influence.
A Conservator can be appointed for the person, the estate or both. A Conservatee is presumed to not have the capacity to contract, sell real estate, incur debt and similar activities. However, this does not prevent the Conservatee from certain activities such as voting, creating a Will or giving informed consent. There are alternatives to Conservatorships if the situation does not warrant such a drastic action. A durable power of attorney or a living trust are examples of other legal measures that may be more appropriate, depending on the capacity of the individual.
